In 1975, the Wisconsin Medical Society created the Wisconsin’s Injured Patients and Families Compensation Fund to ensure coverage and compensation to victims of medical malpractice. But in 2007, the fund was raided to help balance the state budget.
This month it was announced that the state of Wisconsin must repay $200 million it took to balance the budget along with $34 million in lost earnings and interest.
The Wisconsin Medical Society claimed taking the funds was unconstitutional, and in 2010 the Wisconsin Supreme Court agreed and future raiding of fund money is prohibited.
